I was in property management for almost 10 years and our policy was, we accepted dogs 20lbs or under.
Personally I really didn't care what size dog people had, since I'm a huge dog lover, though I do think really large dogs need more space than an apartment offers.
Anyway, I can tell you that time after time courts really weren't sympathetic to enforcing such a policy. I mean if a dog isn't doing any damage or bothering anyone, what difference does it make!
Courts are really pretty busy to deal with lawsuits like this!
Just my experience anyway!
Besides, if you own your home, how are they going to force you out? Even if they put a lien on your property, they would have to prove real damages!
