Do you let him run and play when he comes in the house even if he doesn't potty outside? You said that you take him outside right away when you get him out of his crate and then let him play in the house awhile when he comes inside. For the times that he doesn't go potty, he should go right back in his crate. Eventually he will learn that he gets playtime only after he pottys outside.
