Most life threatening issues are covered in the contract. This doesn't happen to be one. However, if the breeder was aware of it, it should have been mentioned and maybe a discounted price offered, if the testicle did not drop, as peforming a nueter would be major surgery. Waiting till the pup is 8 or 9 months for nuetering is advisable to see if the testicle will drop.
