Be careful with copyright laws because once that person does file, if they file, you will have to deal with the fact that you came after and used the name despite knowing that it existed already. If it ever came down to u keeping the name and copyright infringement you would lose. Try to brain storm a new name, but if u cant keep the copyright laws in the back of your mind.
