Omg My friend's puppy died! Should she take action against the breeder??

My friend got a yorkie puppy last Friday. The puppy was only 7 weeks old but the breeder ASSURED her that the puppy would be fine to leave it's mother that early. The breeder also told her that she even let one of the pups in the litter go a day before it was 6 weeks old!!!!! So, she said the 7 week old pup would be perfectly fine to go. Well, I got this email from my friend on Sunday......

This morning we got up later than usual...Mike wanted to take the dogs outside to go to the bathroom ....when I picked up Addy, I noticed she was making these coughing sounds...with every breath, it sounded like a really rough cough...and by every breath, I mean it. It was constant, with a REALLY horrible sounded whine/yelp mixed in every once in a while that led us to believe she was dying.

We called every vet in town but none were open since it was Sunday. So, we looked up the symptoms on the internet...tried to ascertain what it was, with no luck. We couldn't pin anything down. The situation wasn't getting any better....nor did it really seem it was getting any worse...it was just perpetually bad and just horrific sounding. We could tell Addy was suffering too...she could hardly move...when we took her outside she layed in the grass. When she was laying on my stomach and arm, she'd only move to switch positions a little.

Around 12:30, I noticed she was going downhill. Mike was on the other side of the couch from me, still trying to find answers...to no avail. I was sure that this was probably the end....

Then I looked down...Addy reared her head back over my arm and something came out of her mouth onto the couch. She then brought her head back and coughed again...this time on me. I noticed that this time it was blood that came out...looking at the couch, it was a good deal of blood she coughed up....

...and that was the last breath she ever took.

I looked at Mike and said, "I think she's dead". He absolutely went pale and, like me, was distraught. Addy was laying on my arm still...eyes wide open...not breathing...it was over...

We found a box to lay her to rest in...We apologized to Addy for whatever had happened and put her in the box...

We put her in the box....noticed I had a big smearing of blood on my arm from where she took her last breath....

Just horrible...we had her for a total of 9 days...that's it. And she's dead....
Do you think my friend could take action against the breeder for selling her a puppy this young??????

I told her to email the breeder and this is the response she got:

Chris,

That is horrible! I am so sorry. I could not imagine anything like that happening. All of the rest of the puppies are doing fine. We have sold them all locally and thier owners have been keeping in touch with us. They are all growing fine and just being puppies. As far as the puppy leaving its mother at 7 weeks, our vet assured me it was fine, and one of the puppies even left the day before its 6 week birthday. I apologize for your loss.

In my opinion, this breeder it TOTALLY negligent and should be taught a lesson for selling puppies at such a young age!! What do yall think?????
