I have a crate but hesitate to use it. The accidents don't happen necessarily when we aren't around. A lot of the time he goes out then sneeks off to do it.
Any suggestions? I don't even know how to punish hime since most of the time he does it unknowingly.

You should really try crating him and offering him a little bit more freedom after extended periods with no accidents. After everything I've read here on pottytraining, that sounds like the only way to go.
