Default dog peeing in spite

K so i have 2 issues here.

1.So as much as i read about dogs not knowing spite, its a human characteristic, i totally have a dog thats peeing/pooping out of spite. We put a baby gate up at the stairs to upstairs, becasue Gizmo gets up but gets stuck unless were there to walk down with him. So now when he sees us going up he runs over and pees. I mean its an easy way to get him to go before bed, but sheesh, having a pee pad right in front of the stairs isnt really ideal.
We have tried moving the pee pad, but he still goes there, so makes sense to leave it there. But do you think we will ever get him trained on the pads and not on a spot?

2. Another thing is hes starting to hide his treats, is this normal. Maybe hes getting too many, but we still want to praise for going potty and coming down the stairs all by himself, but i mean hiding them for later, what's he scared were gona eat them, haha! Very weird. He even went so far as to hide one in the grass on saturday and find it sunday.

Anyone experience either of these 2 things?
