No clue..I have never seen the scale pulled out to weigh obviously oversized Yorkies. I have seen the measuring stick to measure other breeds. I would say it is the judges fault oversized Yorkies win.
I could ask the judge to weight a Yorkie who was entered against my dog if I thought it was oversized. Of course it would be my last words before my death.
I think this is a question only the English can answer since they wrote the standard. I would be interested to learn if English judges ever call for the scale.
