I'm not sure of the circumstances so I don't know if it's just a matter of your insurance companies settling the matter or if it's serious enough for an attorney, either way I'd suggest not talking to the other person, let your insurance. In my line of work, I'd suggest consulting with an attorney, it wouldn't hurt anything even if you decide to not go that route, but at least you would know your options. Most PI attorneys work on a contingent basis, meaning you usually don't pay anything and they take a % of the settlement. Probably around 30%. Do not deal directly with the person who hit you, let your insurance company and/or attorney do it. If you are injured be sure all your treatment is documented and keep up with the treatment.
