I would imagine the SPCA already has legal custody of the dogs, but not ownership rights at this point in time, unless the legal owner of the dogs (ie the business has signed over their ownership rights).
I have had some dealings with this SPCA in Montreal who has consistently rebuffed our club's attempt to help with 19 Black Russian Terriers Seized; and yes the owner/breeder will have their day in court.
I find that whole article interesting to say the least, given my recent experience with the SPCA
