No, if you ask me, they can't get their money back. I know, I know, the breeder didn't have a copy of the receipt but that doesn't matter. However, it's hard to tell if buyer take the breeder into court. If the buyer presents the receipt, it would have the agreement on it so the breeder wins. If they don't have the receipt (or claim it was missing) and deny there was ever a set pick-up date, that would be up to the judge - you know he says she says.
So, if you were the breeder and if you were ever going give out a receipt for a deposit, make sure you make a copy or better yet have the buyer sign a document which spell out the agreement of the non-refundable deposit and the pick-up date.
