So they essentially get a loop hole to say they they don't use it.

I just received this reply from Nature's Variety and it was just as I remembered.

"Dear Bonny,

Thanks for emailing! No, none of our diets or ingredients contain ethoxyquin. We have special agreements with our raw suppliers that they do not use ethoxyquin.
