| Dixie update from last fall I am not sure if y'all remember me... but here is the thread I started about our situation. http://www.yorkietalk.com/forums/showthread.php?t=50022 On Monday we had our day in court with this...lady (I use that term quite loosely). She had been served, but failed to show up at court. I stood in front of the judge and gave him my evidence. He showed her absolutely no sympathy and issued an immediate judgement in my favor. I won't go into how much it is for, but it is everything I asked for plus interest until she pays. I don't know if she even knows yet. The really scary part? She is still in business, selling puppies to individuals who have no idea her history. And the newest thing on her website? She is advertising to board dogs in her home. It makes me sick. I am not sure what I am allowed to say at this point or do to make my story known. Are there any attorneys here that could advise me of my rights? My intention would never be to tell her neighbors, friends, family, etc our story. But I do feel that we, as consumers, as lovers of the breed, should be aware of what is going on here. Does anyone know what I can do to get the word out, but remain "legal"? We have come so far. I just don't want to mess it up at this point. |

| Momofone, I remember your story on here, I'm a little surprised no one has replied to your post....Any way I'm so glad you took that woman to court, that had to be a long, depressing, ordeal for you. Your heartache & pain was not able to begin the healing process w/ this case pending.I hope now w/ the legalities out of the way that process can begin for you. It was clear in your posts that Dixie was so loved & cherished by you. I know the monetary judgment must feel so hollow w/ this woman still in business. I so wish I had the legal advise for you to finish the job w/her....Maybe some one here will pm you w/ some advise. Good luck ....

| I'm so glad you won! She really should have had Dixie on a leash. Really sad we try to take the very best of care for our babies, and someone sitting for us lets things like this happen. Hope you got a good bit for the grief you've been through. |

| Thanks. There is no amount of money to bring Dixie back, so it could never be enough, but I just wanted it to hurt her purse. That is all she seemed to care about...so I guess that is how I had to get her. |

| Momofone, I remember you! Your story broke my heart then, and it's breaking anew now. Don't be too upset that so few have responded, YT has been having technical problems, I think a lot of us are just getting caught up I'm glad that you won your case. I'm not a lawyer, so have no way of answering your other questions...and think you are wise to wait. I hope you decide to stick around...

For starters I can't believe she offered to sell you another dog at half price, any genuine person in her situation, being a breeder and all probably would have given you a free pup, especially to avoid a legal battle. Second, I can't believe she did not show up, if she was under subpoena, it is considered contempt of court, and in Pennsylvania would earn her a warrant for her arrest....do you know if that happened in your situation? As far as getting your story out, i would just be careful and choose your words wisely (which I know, i personally would not be able to do this if i were in your situation) she could always come back at you with a lawsuit for slander or liable. Did you have an attorney represent you? Was it all resolved or is there more court in the future? Good Luck! | |

I don't know what else to tell you but if it were me I think I'd want Justice for Dixie in ANY form....that was so negligent what she did and it just should NOT have happened. I still believe she should offer you another dog if you were willing to go that route. Not as a replacement for Dixie but because she killed your dog. Half off isn't good enough. |

| I remember your sad story all to well, it just broke my heart. I don't really have much more to offer in response to your legal questions, but I too would be very careful what I would say, you don't need another lawsuit for slander. But I do agree that if she didn't show up for the court date, and there was a supeona, that should be contempt of court...more trouble for her. And it sounds like money may be your only reward, she sounds kind of heartless and not very responsible, the only way to hurt her is in the pocketbook!!! Again my sincere condolences for the loss of your Dixie, may you once again be able to share that special love with another...Thoughts and Prayers
