| State Law in Washington State We recently got a puppy from a breeder and it has become very sick and we have already racked up $3000 in vet bills. The breeder is saying they will pay the purchase price ($700) but nothing extra...anyone have any insight on Washingtno State Law regarding our legal rights? |

| I am no expert, but I remember with goods (not pets) that you can only get a refund up to the amount you paid, unless of course there is a contract stating otherwise... I will ask a lawyer friend tonight and see what she has to say about it. I'm so sorry to hear about your puppy. |

| Okay this actually entails a really long explanation so I am going to try to come up with something short) and get back to you. I can say that sadly in Washington State the law considers pets a "good" or "personal property" hence their sale will be governed by Article II of the Uniform Commercial Code. What I would ask so that I could give you a better idea of what you are dealing with is this: Did your puppy come with any paperwork at the time of purchase? If so what does it say? What gaurantees were made to you in any way before the actual exchange of money for puppy? Did you have any express or written warranty? When did you discover the illness/what is the illness/did you have the puppy examined by a vet directlyn after purchase,etc? I would like to give you any advice I could, but I should warn you I am only a law student and not an attorney, but I have very few credits to go until I am and currently am doing a clerkship in commerical litigation so I am fairly familiar with sales transactions. |

| Yes the paperwork said we could get paid back up to the amount of the dog. We are pursuing a different angle. It appears that the Vet we took to when he had a small cough could have been the one that caused Chewy's Kennel Cough to turn into Pneumonia. It is my contention that by performing an unnecessary Tracheal Wash he actually pushed the bacteria that was irritating our Chewy's throat down into his lungs causing the Pneumonia to set in. Anyone who has a dog that is experiencing a cough don't let a Vet do something that is overly aggressive... |

| I'm sorry about your furbaby and your experience! I too bought a yorkie that was sick and had problems with the breeder UNTIL my neighbor which is a breeder told me about our California Lemon Law for sale of animals because we have one for cars too. Ours state that the breeder has a few options, take the dog back and give you pick of the next litter, take the dog back and refund you ALL your money or refund you the money you bought the dog for and pay ALL medical expences! maybe there's a similar law like this that might help you. For me I told the breeder about her rights and mine abd she opted to take the puppy back and give me a refund because I did not want to deal with such a breeder again.
