The community service assignment was part of an unusually tough sentence given to Luis Martinez, 23, after he pleaded guilty to animal cruelty. Bronx Supreme Court Judge Megan Tallmer also slapped Martinez with three years' probation, barred him from having contact with dogs for three years and ordered him to appear before her every two months. The sentence begins in April. "The conviction of Mr. Martinez is gratifying," said Dale Riedel, a vice president of the ASPCA. In February 2004, Martinez was arrested outside his apartment at the McKinley Houses in Melrose on charges of animal cruelty. | Oh, that is heartbreaking! I don't know how people can do the things they do. As far as the punishment fitting the crime is concerned, I'm afraid I would be more strict in the punishment of anyone abusing a helpless, defenseless domestic animal. 350 hours is a drop in the bucket. Three years probation? It doesn't mean a lot in today's society and I'm guessing it won't be strictly enforced.

| I think he got off easy. I say the punishment should be the crime they commited, Let him starve for a week or so.

| that is so sad! That poor baby! And to think that he could have just given it to a caring family! I think they should make him go without food and water for a few days! Lets see how he likes it!

| When it comes to animal abuse, I don't think the punishment fits the crime, EVER! They always say,, COULD get 10,000.00 dollars in fines and 5 years in prison, but when it's researched they get small fines and probation,, AND can own animals again ( some eventually) WHAT?! I have a real problem with that part? WHY?,, why should they ever be able to have a pet,and let the animal love them,, after what they have done, and will probably do again. Don't get me started on that,, that irritates me to no end.

Btw, years ago, my little brother "chose" community service instead of paying a fine....he's thinking he'll pick up trash or something like that....nope he worked the police dept horse stables, the pound kennels and runs...shoveling poopie. Said he never realized there could be THAT much crap in the whole world....and if there was a next time, he'd just pay the $$$. PS He didn't starve anything, it was a traffic summons.....

| No I do not think this was a tough enough punishment. He should have gotten jail time. Animal cruelty even if it is neglect is a serious crime in my opinion, I am sick of prosecutors willing to cut deals and judges not willing to crack down. It takes such little effort to put kibble in a bowl, or even to put your dog up for adoption, if you cannot handle even that basic responsibility that comes with pet ownership...HE SHOULD HAVE GOTTEN JAIL TIME!!! I am so sick of the absolutly hubristic attitude courts, judges, and other people exhibit when dealing with animal cases. It is an outrage to me that people like this get such light sentences, and why is this? Because people tell themselves since animals are less intelligent than humans they should not have legal rights. That is just stupid in my opinion. In fact no one would question the rights of human babies or severelly mentally challenged adults, and many animals have far higher intelligence then they. Dogs can without a doubt experience pain and they care about their lives and the lives of their loved ones, they deserve to be treated compassionately and not have to live in fear of torture or death or people treating them however they please, causing their death and getting a slap on the wrist. It is really irrelevant that animals do not posses the same intelligence as humans or communicate in different ways, or that they are kept as our pets. In their capacity to suffer and feel pain animals are our equals and people who torture them by withholding food should get sentences more commenserate with their crimes!!!

| Oh my goodness how heart breaking. I don't think the punishment was stiff enough. I think they should have done allot more than they did to this person. Makes me want to cry and then I wonder how many others like this person is out there doing things like this and not getting caught. Makes me want to thank God for my babies, knowing they are all loved and taken well care of at whatever the cost. |
