| Question: Homeowner Insurance... The home I just moved out is currently being "fixed up". The roof is the original which would make it about 22 years old. Now.. We've had quite a few storms (including nasty hail storm) the past several years. While making a claim with our insurance, the adjuster denied our claim stating: The roof being the original, the damages are considered wear/tear. But then, he approved the cost for fixing the water stain caused by the leaks on the ceiling. I'm currently fighting this but not sure if this is something I can win... Anyone deal with this sort of thing??? MISTY!!!!! You worked in insurance, right??? Any advice?! |

| Most roofs come with at least a 30 year warranty. I would appeal saying while some wear and tear should be expected a 30 year warranty means it should not leak in that time and that the storm definitely caused the damage. Insurance companies are a pain in the a$$

| In Texas, we have the Insurance Board in Austin....if you dont like what is happening between you and an insurance company, contact your State's Insurance Board....I drug Blue Cross/Blue Shield to them way back in 1978 because they just flat refused to pay my son's hospital bill....the Board reviewed the case, sent them a letter saying they had 14 days to settle that claim or all further interactions would be thru THEM....I received my check within 8 days....I was working thru them again, against my homeowners following Hurricane Ike....a very reputable insurance company that I had been paying out the yazoo for COMPLETE COVERAGE, to cover present day replacement cost of my home intotal....that was a huge policy and I had struggled all those years to be sure THAT was paid....then they decided they wanted to reimburse me a paltry $60,000.00 for the destroyed home and furniture I incurred from Ike....80% wind damage, 20% rain damage...NO rising water/flooding.....I had to take them to Austin 5 times to get my repairs covered, and they STILL came up short....I let the down trees and fence damage go, simply because I was exhausted from fighting with them.....they KNEW they owed me all that, they didnt dare drop me....but I started looking around and I went with a #2 rated company....I pulled up the top 5 companies and #1 was just too expensive for me....but I do have #2 now.....of course, that was about 6 years ago that I changed companies, and while they are still a highly rated company, they are not #2.... If you can not get what they owe you, contact the Insurance Board in your State...they will review the case and boy, here in Texas, they come down on them HARD, giving them 2 weeks to cut you a check or else! | If it is a 30 year roof, probably would need some proof of that, and your claim would be adjusted for age.

| Just went through this with the inlaws. Their roof was past it's life so their insurance forced them to replace it, or wouldn't cover it in the event of storm damage. We are 17 years into our roof with 30 year shingles. I'm not sure if were to have storm damage that will be pro-rated or not. There is a lot that comes into play here, it depends on what kind of policy you buy, the life span of your roof/shingles, and who you're dealing with. If I could recommend anything, it would be to hire your own adjuster for a second opinion.

Since he/she didn't, get some repair quotes or let them do it and just check your deductible is worth paying out for the repairs and increase to your premium next year. Hope this helps?? Thanks for the clarification. I did notice some leaking and had a roof guy come take a look several years back (less then 10 years ago). He said rest of the roof look fine and just replaced some plastic ring thing. Anyway... Come visit!!!! I have a nice bottle of wine all chilled for you! | |

| That's because they don't like to disclose discounted rates from providers or their own fees. They try to withhold this info from brokers too on occasion. Keep asking for it and in writing so you can dispute what you need to if it comes to it like cause of damage and costs. |
