| Illinois Job Laws??? Back in November, I started working at a clothing store in Chicago. I really like my job and my manager has told me that I'm good at it. Well a few days ago, she calls me in for a meeting and tells me that I am being put on a 2 week probation because I don't seem happy while I'm at work. I didn't really think I came off as unhappy, but I'm going to try to act peppier at work. Well then she said, "When we call you to see if you can work for someone else, you hardly ever want to come in." We have this thing at work called "on call" If the regular person calls out, then the on call is required to come in and work that shift. I asked if I was still required to come in even on my day off, if the on call isn't answering the phone. We have alot of people who have two jobs, so instead of being ready for on call, they are at their other jobs. Now if any of that made sense, does she have a right to fire me because I don't come in on my off day??? This is really upsetting me because I really like my job. I wonder if shes just ganging up on me because I don't like working on my days off, even though I have before. She even had the nerve to complain because I didn't come in on one of my off days because I was home studying for midterms I had the next day. |

| If Illinois is an "at will" state, they need no reason whatsoever to fire you. Many states are like this.

| Are you talking about your days off, or your oncall days? I've worked a few retail jobs, and most had on-calls. At my place we have oncall, and you are supposed to call in one hour before your oncall time. Sometimes they forget, and we'll tell them about it next time, or if we need them we call them. Also, if we know we'll need them a prior to when their supposed to call, we'll call them. You are supposed to show up for your oncalls, just like a regular shift. Because my place only staffs a few people, if you are no show/no call you are automatically terminated, even if thats for an oncall and you were needed for it. If your not scheduled that day or not on call, then you shouldn't be required to come in and shouldn't get in trouble for that. At the other places I worked they treated oncalls like regular shifts as well, if you weren't able to make it in for oncall you could still get in trouble.

| Here's my advice for what it's worth.... I would go to her the next time you are on and tell her how much you love your job and enjoy working there. Tell her you are not sure why she has the impression you are not happy but you will definately try to put a smile on your face and that you really want her to know how much you value your job. By the way, you haven't complained to anyone else have you? Because maybe someone is repeating anything you might be unhappy with. Then, I would screen your calls when you are not at work and help out when you can or feel like it or are on call but if you don't feel like it, you can just say, I'm sorry I wasn't available. But I would also pitch in on occasion and definately when you are on call. Good Luck! |

| To keep from getting calls to come in earlier than my shift (I can say no but they make you feel guilty), hubby takes the phone off the hook when he leaves in the morning. Then I can sleep for several more hrs before i have to be into work. If they can't reach me than not my problem. We do have alternates on Sat. If you sign up you have to be available if they try to call you.
