Default Stunned!

I purchased a Yorkie in May and have been trying to get the CKC registration papers from the "breeder" as promised in a contract but to no avail. This AM I decided to do a little investigating and to my horror, I found this puppy was raised in a puppymill and it was shown on CBS news but I was not aware of it. I woud like to know if I can sue the people we purchased the puppy from for false advertising and breach of contract. If anyone has any helpful info on this please advise.

Hi and welcome to YT.
Im sorry to hear that
What is the name of the breeder or kennel which you purchased your puppy from?
And what wording did they use in the advertisement?
I dont know if you can sue them for false advertisement unless they said they were not a puppy mill.. but im not sure on that one.
I bet there is some sort of legal action you can take though!
Im sure another member will be along with better advice soon, sorry I couldnt be of furthur help.
Hope your little one is doing well and good luck!

Well I watch Judge Judy alot and as many times as I've seen deceptive breeders and customers, they always say if you want your money you have to give back the dog if the breeder will take it. I don't know how you feel about your dog but I could never give mine up although some people do.

I think it depends on the puppy lemon laws in the different states whether you have to give the dog up or not.

Probably if she has something in writing that she was getting the papers and it was part of the contract, they didn't fulfill the contract she may be entitled to part of the purchase price back, because of the breach of contract.

Getting a Dog Tips - California's Puppy Lemon Law

Here you go, that might help. Although, it will surprise you what puppy mills get away with. False advertisement is seriously tricky and not the route I would take. If you signed papers, that is just it...you signed papers. Why did you not research them before buying? You can get the CKC registration yourself too.

The CKC registration should have been a tip-off; if you are referring to the Centennial Kennel Club and not the reputable Canadian Kennel Club, this is not a registry, that I would suggest bothering with. I think they even took their intials to mislead unsuspecting buyers. They will pretty much register anything and take the breeders word for whatever they say the puppies are. I personally believe you should assume that the breeder is a poor one until you do much investigation, and a home check is always needed to ensure you are not supporting a miller. You really have no recourse for "false advertising"; ninety percent of breeders are guilty of that! Let this be a learning experience, and please try to support only those breeders who are breeding for the right reasons, and that's to improve and preserve the breed. Otherwise, you are just supporting a salesperson, and sales people have been know to stretch the truth, that's their job after all, to sell you something! Many breeders "pretend" to care about the breed, but their motives are obvious if you look into their breeding practices.

Even if you get those CKC papers, it's not really going to do you much good. As far as CKC (and APRI,ACA, Etc) it really is just a piece of paper.

Did you purchase your baby from a pet store? I used to live in Pismo Beach and know there are several 'boutique' type pet stores in that area that can be pretty misleading. (I actually almost bought from one before I got my first maltese - I still can't believe that!)

As far as suing, not sure what legal standing you have. If you were hoping for CKC papers so you could breed your baby and have the puppies registered with CKC, I'll just say that you do not want to breed this pup. Coming from a puppy mill, you have no way of knowing the genetic background, which could be a horror story and you do not want to pass it along to a puppy buyer.

There is a show November 20-21st in Paso Robles, you should come watch! There is usually a significant yorkie entry. I'll be there showing maltese (or my 11 yr old daughter will)

So sorry you had to find this out! Just love your baby and hope that it all works out in the end.

Nicely said. I think I will be attending that show :-)

You may be interested in talking to an animal law attorney or contacting the Animal Legal Defense Fund to see if they have an accurate answer.

Best of luck!

Default Thanks

Thank you to all who responded to my question. My baby Yorkie is a healthy, beautiful puppy. After thinking about the situation, I've decided to just let it go and be grateful for this wonderful addition to our lives. We think she is the cream of the crop and we don't need papers to love her. I am just happy that we got her out of there and can provide a loving home for her. As soon as I learn how to add a picture of her to this I will. I have many more questions so I'll continue to visit this great discussion forum. Thanks again

Actually, I did have it in writing as part of the contract but not worth my time or money.

I would never give up my dog.

Welcome to YT! You are in very good company along with so many other members that also found out the hard way about puppymill and disreputable breeders. It can be very confusing and difficult to the inexperienced person to figure out who is doing what~there are a lot of very good breeders but you need to sort through all of the garbage to find those diamonds.

If you need help uploading pictures just ask Can't wait to see your beautiful little girl.

It baffles me....how could anyone buy a dog from a puppymill and NOT realize that's what it was?

Could have bought from a broker, not realizing it was a broker and the puppy came from a puppy mill.

Could have been from a petstore (and how many pet stores swear up and down that their pups don't come from puppy mills and they know the breeders of the pups they sell).

Unfortunately unless they do the research many people do not realize that the brokers or pet stores get their puppies from puppy mills.

she did not do the research to find out how to properly breed dogs she honestly knew no better.

Maybe not everybody looks for bad in things. If you are not dog world savy then you forget about things like puppymills. Sorry you are baffled. It must be nice to know everything. I fall short in that area, I'm just a simple minded person I guess.
