| Deposits...Are they refundable?? I have a lady who wanted to purchase a pup from me(I thought she was a good friend)...She put a deposit down, (she gave me party lite) as the down payment, she sold it to me for $100.00. I sold her a previous pup for $500.00. And told her I would give her a good deal. Now she backed out of the pup and got a pup from somewhere else. (for triple the price) Now this was back in Sept 07. She now is harassing me, letting the phone ring around 30 times. Wanting her money back. My husband told her that that was a damage deposit and because she was the one that backed out it was non refundable. Now if the pup was sick or such, we would have been more than happy to do a refund. She says well that wasn't a deposit, it was going towards the dog..Is that not the same thing? She told my husband because she had given me this party lite, if she would have known I was going to screw her around she would have charged me $250.00.?? She also told my hubby she thought by giving me this party lite the dog was paid off...(nothing was ever said like that on my part) Then says in the next breath, well if we let her use Peeka for a stud she would then consider the debt paid off....(Peeka is her dogs dad...I think not!) Now am I wrong? I now owe her?

| No, she shouldn't get anything back, she backed out of the deal. Sounds like she is making a big deal over something not even worth it, its not like she paid you in cash. I don't think you owe her anything(although, might be worth it to give her back her light just to be done with her, and know she's not much of a friend ) Good luck with whatever you decide to do |

| My deposits are non-refundable unless something happens to the puppy while I have it. or if I decide not to go thru with the sale at my discretion. of course they get it back in that situation. if they just change their mind after I have held the dog for them, they do not get it back. Did you not have a purchase agreement that you both signed? |

| No there was no papers signed yet, she waited unti lthe pup was 12 weeks old then just told me that her hubby out of the blue decided to buy her another pup, and it was left like that. I may also add that she demanded to come over when the momma was in labor I told I really do not think its a good idea it adds more stress to the momma, she didn't listen to that either, let her self in the house( I had my hands full of puppy gunky) and to top it off she was frickin sick!

| I wouldn't think you owe her anything. You said she bought her previous pup from you. Did you sign an agreement that time? Does your agreement have anything in it about the deposit? What I am thinking is, if it does say something AND she signed one before then she new at the time that you don't refund deposits! I am stunned that she let herself in your house after you told her no! This is no friend! So sorry you are having to deal with this.

Donating YT 14K Club Member | Sticky situation! This should have been discussed at the time the party lite was given/sold. You can never presume that deposits are refundable/non-refundable. There needs to be a written or verbal agreement. If she wants to take you to court, it could go either way. Also, she could slam and bash you and that could hurt your reputation. Sometimes, the money isn't worth the headache you'll have to deal with later on... Good luck!

Donating YT 10K Club Member | Some breeders will refund deposits for any reason and some will not. I guess it depends on whether you want to retain her friendship...although I'll say it's probably over any way.

| At the time she bought my first pup, she was already 5 months old, and She saw her and decided on the spot she just had to have her, I had wanted to keep her, but decided that she seemed to be a nice person, and that she wanted to spoil and love her. Now i have to say this she does take very good care of her, and is spoiled rotten( clothes) but when it came to this pup, she HAD to be there when she was born etc. then she found out that I was not going to give her this dog for 200.00 then she backed out. Business is business and that was stated more than once. Party lite is candles and asserories. She kept pushing the stuff on me becasue she knew i had 2 weddings to go to. And she said point blank this is to go towards the pup and how excited she was. She turned around and backed out, and went to the states to get another pup. I was very nice about it, but decided not to have much to do with her after that. What is making her the madest right now( I just talked to my husband) is that I wouldn't go to see her new baby. She wants to start breeding and she had it in her mind she was going to get into breeding doing it the free way, and makes tons of money... And sorry I am not into that! And will not have my name associated with her ways of business etc!

| tough one. Personally I think she backed out so it's her loss, but sounds like for a $100 bucks it might be worth it just to give it back to her and say good riddance.

| I say she is not entitled to a refund because she is the one that went and got another puppy from some where else....you lost out on money because you could have sold the puppy instead of holding it for her!!! Puppies don't eat air and I am sure at 12 weeks you had all the shots done etc...hey i would block her number and tell her to take you to court!!! she will spend more in court costs and time then the initial 100.00. Some people think that if they harass you enough you will cave in...forget that !!! tell her take you to see Judge Judy!!! LOL seriously though good luck with whatever you decide to do!!!

| she never talked about breeding to me ...she always said she wanted her girls...but yesterday is when she told my husband that she wanted to use peeka for a stud, to call the debt paid in full! I had a legal letter written to her as well, and wrote a check for a 100.00 to get her out of my hair forever. When my husband gave her the check, he said wow you really must be desperate for a hundred dollars she got mad and tried to give him the check back...My hubby said oh no you keep it, and you will not put our name in the mud. so hopfully all is done!
