| How is a Breeder Legally responsible? I posted this question in the General topic board, but now that I'm thinking about it, it may have been wiser to ask it here. I got Monster about a month ago. When I got him, I knew full well what I was doing. This woman advertised UKC registered bred Yorkies and was charging typical Yorkshire Breeder prices. When we arrived to pick out our puppy it became incredibly apparent that she had in fact just purchased a dozen or so Puppy-Mill Yorkie Types and was increasing the price. On top of it, these puppies were filthy! It was obvious that they had been left in a room by themselves with food, water and papers and were never socialized with humans, only with the litter mates (however, we can't even be sure they were related). Later, I discovered that Monster could not even be registered with the UKC. By the time I was leaving with him in my arms, I knew that accord and satisfaction had been met regarding my personal issue (yay first year law student!) and had over paid in order to rescue this dog (well worth it). BUT... Do any of you know if she's broken any kind of law in regards to misrepresentation (for instance saying they were bred when they weren't, or by lying about the UKC registration)? Or if not socializing a puppy with humans is considered abuse? Even if I can't take any legal recourse (which I don't believe I can), is there any breeder association that I can report her to? This woman just cannot keep doing this to people! Thank you! |

| Well I am glad you were able to save one baby and give her a great home, but as long as people keep buying these puppies from breeders, brokers and pet stores like this she will keep breeding. As for your little girl , she is just a pet and you do not need any papers, so enjoy your puppy, she is going to give you years of happiness. |

| Thank you so much for your input! Yes, we are definitely very satisfied with our little baby boy. He has become what life revolves around for us. We're just disgusted by what this woman was able to pull off. Lying about the puppies origin is one thing, but treating them bad on top of it? I fell in love, but there were still puppies left after we got our Monster. My concern is that someone will come in expecting liniage and papers, see what is going on, and not buy the rest of the puppies. If there are puppies left over, I'm really afraid of what she can do that has the potential to go unnoticed. My boyfriend says I'm over reacting. Maybe, but...if anything I want her stricken from sites devoted to reputible breeders. |

| My boyfriend picked it. I picked the breed (interestingly enough because I was a German history major as an undergraduate student and learned about the Heroic Yorkies of WWII) so he got to pick the name. If it was a boy it was Mr. Monster, hence our baby's name. If it was a girl, he wanted to name her Snack Pack! |

| Well I have groomed for almost 30 years now and I have never known a Mr Monster. It is a very cute and I am sure a fitting name for a yorkie boy!! |

| A breeder should always be responsible for the puppies they bred . My sale contract stipulates , if for whatever reasons the new owners is not able to take good care of the little one , I'll take the puppy or adult back to my home . |

| Welcome to YT and thank you for taking little Mr. Monster even though the breeder misrepresented herself! I would think the only way you would be able to legally pursue her would be if you had it in writing. Unfortunately these type breeders will tell you verbally anything they can to lure you in. They count on the fact that once you see those darling little faces and hold them in your arms, you're a goner!! I thank God every day that we were blessed to find a wonderful breeder and everything she told us was true and three years later, she is still very supportive and always interested in this little one entrusted to us! It also states in our contract that if for any reason we cannot care for Toto, she goes back to the breeder.

| Its seems to me you would have legal recourse because of her inability to produce papers as promised. If it states in your contract that your baby is UKC registerable then she needs to provide you the papers to do so. As Debbie said you have purchased a pet and a pet doesnt have to be papered to be loved and give love, enjoy him, but I do understand your anger you have been deceived, the seller misrepresented the parentage, also claimed she was the breeder of record and that your boy was UKC registerable. A paperless puppy would be priced less than a papered puppy no matter the registry at the very least you should be refunded a portion (more appropriate pricing for an unpapered pup) that you deem reasonable.
