Default Need some advice, please

Ok, We just found out that Sophie has legg Perthes disease. I am just sick, my stomach is all upset. Sophie will be 11 months old on the 12 of may, and is schedule for the surgery on Tuesday. We will then get her spay at a later date. Doctor does not want to do both surgeries at the same time.

We brought Sophie with a 1 year guarantee against any hereditary illness. Have talked to the breeder and said she would work with us if we went to her Vet. Which we did. When we were at the vets office the vet called the breeder and informed her of the diagnosis. She said she did not want sophie(which we are not willing to give her up) But told the vet we could have a new puppy.

Now she is saying that if we want a new puppy we will have to give sophie up. Or if we keep sophie we can have a puppy for half price. We do not want to give sophie up and really do not know if we want another puppy. Do you think we could ask for help in paying for the surgery? The contract says "a replacement puppy will be given".

Please help

Well, you can ask her to help, but if the contract you signed says "a replacement puppy will be given," then that is all she is legally entitled to do.

I know, but if we would give sophie back to the breeder she would have to pay for both surgeries and would be out a puppy. I feel just terrible because it is a no win situation for anyone.

did the contract say a replacement would be given for return of the current puppy?

No, it says. "If a hereditary illness arises in the first year of this contract a replacement puppy will be given, providing a letter from a veterinarian showing evidence of an illness is submitted. You must contact me berfore treatment to validate this guarantee, so I may get a second opinion from my veterinarian"

Which we did and when we went to thier vet, I really liked him and he is a ortho doctor so I thougth great this will be best for sophie. Which if what we want. She is such a great dog and we love her to pieces.

hmmmmm....I'd take the contract to a lawyer and see what they have to say about it. I don't know that you'll have any recourse but that is how some breeders do their business. They KNOW that you will not want to return the pup so in the end, they do not have to shell out any money. HOWEVER, it would be nice for the breeder to reimburse you the cost of the pup.

I am not even looking for them to give me my money back. But if I were to give her sophie back, they would have the cost of the two surgeries plus they would loose a puppy, so I thought if they would help with some of the cost of the surgery they would not be out that much as if we returned her.

Yesterday when we were at the breeders vet. The doctor talked to them when I was there and they told the vet that we could keep sophie and they would give us a puppy also. So when they called me last night they changed there story. And I think it is because she know we will not let sophie out of our lives. Plus I really do not know if we want another puppy. We just purchased a puppy three weeks ago. So that would be 3 dogs.

Every breeder knows it looks good on paper to say you will give a replacement puppy...but the reputable breeder will never ask you to give up your companion in order to get the replacement..and that is what the disreputable breeder counts on...few will do it.
Be sure to tell her vet exactly how you have been treated..and take her to small claims court..in Md the breeder must pay for vet fees up to the price of the dog..here in Florida it is even more.

So do you feel it is not to much to ask for some help with the medical bills? And how do you think I should go about asking. I feel that when I left the vet everything was fine but I kinda feel she is playing me, because she knows we love sophie and will not give her up.

As a breeder my contract states the samething.. a replacement pup will be given of the same quality.. Now as a breeder I also know in situations such as yours needs to be looked at on a individual basis.. Now if you didn't want a new pup I think the right thing in this situation would to pay for up to the purchase price on the surgery need to get Sophie taken care of and try to give her a quality life. This is what is the most important over all and should come first. As the owner of this pup this is what I see you wanting for her as well.

Now, if you wanted a replacement pup and keep Sophie as well so she continues to be cared for properly I think this should be honored if you take on the surgery costs.. Because Sophie deserves your love especially going through all of this in the first place...

We used to raise American Bulldogs. Our contract stated that we guaranteed the pup against genetic defects for 2 years if the dog had not been bred. We would replace the pup if the other dog being replaced was either returned or spayed/neutered. We never wanted to rob a family of a beloved pet just because something went stupid with their health. Thank goodness our of our one litter we raised, we did not have to replace any pups. I think the best thing for your breeder to do would be to let you keep Sophie since you are having her spayed. If you don't want another pup, she should pay for the cost of the surgery up to the price she would have gotten for that pup. If she gives you a pup, she is going to be out the money for the pup anyway...might as well pay for the surgery. I hope you have something in writing, but you should not have to defer to that. She should offer to do the right thing. Good luck!

So sorry to hear that Sophie has this, she is a very lucky little girl to have you and your hubby to love her and care for her needs now. If I were in your place I think I would just forget about the breeder and do what needs to be done for Sophie and go on from there. The frustration of trying to get help from someone that apparantly don't want to do right can cause prolonged frustrations which you definately don't need. I wish you the best, I am glad to hear you love this little one so much that you aren't willing to give her up, am sure God will over see in her operation and care and she will be ok. Please keep us updated on how Sophie is doing. Thanks, Patti

Default Sophie had the surgery

[/b]Sophie had surgery on Tuesday. After crying(me) at the vets, the doctor agreed that we could take her home last night. (He wanted her to stay at the office, which I did not want her there all by herself.) So she came home and is doing great. She is already starting to rest her leg on the ground and is not showing any real pain. We are so proud of her, she is such a big girl!

The breeder has agreed to pay for medical bills up to half of the cost of sophie which already happened, I am not sure who will be responsible in the cost to get her spayed. But it needs to be done.

Thank you to babyblessing. Sophie has been such a blessing to us, we love her so much, and I truly believe that God is watching over us.

I am happy to hear that Sophie is doing well. I am sure this has been very difficult for you. Sophie is lucky to have such wonderful loving people parents.
