| Contracts I just wanted to send out a reminder and caution. I have seen many people buying pups lately and not getting good contracts. When buying on line or out of state you have to be careful. Your contract is your only way to get help if your pup is ill. Not that everyone honors their contracts but its a start. Most states have limited or no puppy lemon laws, so small claims court in their state is where you would end up if you have a problem so if it isn't in writing it its no good. Check out the contract carefully before buying and be sure you are covered. It really is buyer beware. |

| That's good information for potential Yorkie parents to know, CC's. What kind of health guarantee do you think should be standard, in terms of length? 3 months, 6 months, one year? |

| I think a good contract protects the pup, buyer and breeder. No single contract has everything but there are a few things I would run from. I have the most problems with contracts that only give 48 hours for disease. Then if the pup comes down with parvo 4 days after receiving it your not covered. But I also think a new pup should be kept at home inside until all its shots are complete. Thats a new owners responsibility. I also don't like having to return your pup for an exchange. If the pup is being well loved and cared for it should be allowed to stay, and a refund should be given to help cover expenses. But the breeder should be notified immediately and given the chance for a 2nd opinion too. I think most serious illness will show up or can be screened for by a year of age, except PRA. So I would want at least 6 months to a year. |

| I also add on my contracts: If for any reason you can no longer keep your puppy, I would like first option to buy the puppy back. I don't want my pups ending up in shelters or just given to anyone. Am I the only one who does this?

| yes you are the only one that will buy back... most would just offer to take back the dog but not buy back.... what rate do you offer the owner when you buy back??? i might want to do this too... |

| Sexcbruclee, So far I never had to. If they have had the pup for 6 months or less I would buy the pup back at full price unless they made my pup sick by neglect or abuse.I WILL NOT pay someone who has hurt my pup! But if they had to move to an apartment where they were not allowed pets, yeah I'd buy him back. But like I said it varies according to the reasons.

Agreement of Sale Sold to___________________________ Yorkshire Terrier M F Reg. or Ltr. #___________________ Sire________________# Dam____________________# whelped________________________ (One third of the sales price is to be forfeited if the dog is returned for any other reason than failure to pass Veterinarian examination.) Price $____________ Paid cash_____ or check_____ Driver license #_____________________ Sale is contingent on Full Veterinary Approval within ___96____hours, and healthy bile acid test results under 25 at ten weeks of age. If this pure bred dog does not have your veterinarian's approval, please return to breeder/seller's premises with the period of time designated above for a full refund. If this dog develops a serious hereditary disease, with the exception of luxating patellas which cannot be guaranteed on any toy dog as injuries are common similar to a trick knee on a football player, or trachea problems which can be the result of careless intubation or severe bronchitis, specifically, but not limited to legg perthes (one year guarantee) or hereditary liver shunt, (five year guarantee) a full refund or, another puppy, shall be given as a replacement whichever is mutually agreeable. (To further elaborate Buyer may choose to keep the dog and get a full refund/or another puppy when available, and be responsible for the medical correction of the dog). Breeder/seller is transferring this dog as: (breeders initials will show intention) Show Potential______ Breeding _______ Pet Quality only________ (requires pet be neutered/spayed at appropriate age) Breeder will release papers upon receipt of certificate of neuter or spay: Breeders initials____________ Buyers Initials___________ To the best of my knowledge, this pure bred dog is in good healthy condition with the following exceptions: __________________________________________________ __________________________ Medical History Veterinary receipts are included and show that this puppy/dog is current with its vaccinations for its age. This puppy has been wormed (If applicable) ________ times. Have your veterinarian check the puppy teeth at 8-11 months to remove the retained puppy teeth. This breeder prefers NOT TO USE LEPTO in puppy shots. This breeders VETERINARIAN prefers to use Isoflurane, or Sevoflurane, gas anesthesia if surgery is required. Injectables must be used only with great care and breeder assumes no liabilities for consequences when an injectable anesthesia is used, and the veterinarian is to use care in intubating this toy dog so as not to damage the trachea by using a tube that is too big. Initials: __________ THIS BREEDER WILL REPLACE THIS DOG IF IT DIES DUE TO ANY HEREDITARY PROBLEMS IF THE FOLLOWING CONDITIONS ARE MET. Buyer must consult with Breeder within 24 hours of any illness and follow advice of Breeders Veterinarian. Buyer must have any autopsy performed by the Breeder's Veterinarian or Breeder's Vet of choice within 24 hours of death. Under no circumstances is Seller to be held responsible for medical services not authorized by the Seller. This breeder does not sell to homes that have children under the age of 8, or any other dogs over 15 pounds living in the house. Any inhumane or abusive treatment of said puppy/adult will result in immediate termination of rights of buyer and puppy/adult will be returned to the possession of the breeder, without compensation. Buyer will be responsible for any legal fees and/or court costs that may be made during the repossession of said puppy/adult. Any breech of this contract, by the buyer, can result in a penalty of $5000.00, payable to the breeder, in addition to legal fees and court costs. It is mutually understood and agreed any that any litigation issues regarding this sale shall be brought about in the County and State where the Breeder/Seller resides. Breeder/Seller and Buyer certify by signing this bill of sale that this dog is not sold for resale purposes and that the breeder will be notified if it is necessary for this dog to change hands for any reason and the right of first refusal will be given to the breeder/seller.
